Le Club Lacoste Loyalty Program Terms and Conditions

 

 

 

  1. Legal Information

Lacoste Australia & Lacoste New Zealand (hereafter "we”, “us”, “our” or “Lacoste”), represented by True Alliance Pty Limited (ACN 098 282 001) , with its registered office at 19 O’Riordan Street Alexandria, 2015  has developed a loyalty program entitled "LE CLUB LACOSTE" (hereafter referred to as the "Loyalty program" or "LE CLUB LACOSTE"), designed to reward their customers who frequently make purchases at the Lacoste Stores (excluding Outlet and third party stores) based in Australia (AUS) and New Zealand (NZ) and on the following e-commerce sites: lacoste.com.au and lacoste.co.nz

Any reference to “us” or “our” within the context of these General Conditions refers to both Lacoste AUS and Lacoste NZ.

Any reference to “you”, “your” or “the Member” refers to you, as a member of LE CLUB LACOSTE.

These general conditions of LE CLUB LACOSTE (hereafter the “General Conditions”) govern this loyalty program, and apply from the time you join LE CLUB LACOSTE.

  1. Scope

The LE CLUB LACOSTE loyalty program is in force in all the Lacoste Boutiques located within Australia and New Zealand, with the exception of those indicated in the appendix, as well as on the www.lacoste.com.au ecommerce site (hereafter the "Website"), for purchases made from within Australia and New Zealand (hereafter the "Scope").

A Lacoste Boutique consists of a point of sale operating under the Lacoste trade name and exclusively intended for the sale of premium Lacoste-Brand products, to the exclusion of any others (hereafter the "Lacoste Boutiques").

Lacoste Outlet Stores, any Multi-brand, Franchise and Concession stores that sell Lacoste-Brand products, as well as any Lacoste Boutiques and websites outside of Australia and New Zealand, are expressly excluded from the Scope.

  1. Method of Joining

Members join LE CLUB LACOSTE (hereafter "the Membership") at one of our Lacoste Boutiques or directly on the Website.

To join directly at a Lacoste Boutique, simply ask the sales associate to join LE CLUB LACOSTE. Any customer or prospect account created in a Lacoste Boutique, will automatically join the Loyalty Program.

You may also join LE CLUB LACOSTE directly on the Website: www.lacoste.com.au/register via a compatible computer, tablet, or telephone:

  • by clicking on My account and creating a personal account,
  • by subscribing to the newsletter via Website pop up, you will automatically join the Loyalty Program (please note: you must create an online account to log in and view your level), or
  • by creating an account or subscribing to the newsletter during a purchase on the Website
  • by entering an acquisition competition or campaign hosted by, or in conjunction with Lacoste AUS or Lacoste NZ, which will state specifically if it is for the purposes of the Loyalty Program you will automatically join.

It being specified that any membership of LE CLUB LACOSTE is strictly free of charge and is not subject to any purchase obligation. On the opposite, in case you do not want to join LE CLUB LACOSTE, you can still make a purchase:

  • in a Lacoste Store without providing an email address for the purchase, or
  • on the Site by purchasing as a Guest without creating an Account and without subscribing to the newsletter.

When you join LE CLUB LACOSTE online or in store, some mandatory or optional information will be requested, as indicated hereafter:

  • Last name
  • First name
  • Email address

Optional information

  • Title
  • Address
  • Post Code (not optional on Website Account Sign Up)
  • City
  • State
  • Date of birth (not optional on Website Account Sign Up)
  • Mobile telephone number
  • Gender (not optional on Website Account Sign Up)

You must also indicate whether you wish to receive marketing communication relating to the Lacoste Brands, either by confirming this to the sales associate at the Lacoste Boutique, or directly and expressly agreeing to this in your Customer Account (such as this term is defined hereafter), after registration on the Site, or by subscribing to the newsletter.

Your Membership is effective after it is registered by the sales associate at the Lacoste Boutique and after receiving the welcome email confirming your Membership, or when you confirm on the Site. A welcome email confirming your Membership and the activation of your Loyalty account (as defined hereafter) will be sent to you within twenty-four (24) hours of your registration, subject to the express condition that you have provided your correct email address and have consented to receive marketing communications.

Any customers who were already registered in our customer data base at the time of the loyalty program launch shall automatically become members of LE CLUB LACOSTE.

We would like to draw your attention to the fact that as this loyalty program is common to the Lacoste Boutiques and the Website, you will only be assigned a single, unique loyalty account, with your email address as the username (hereafter referred to as the "Loyalty account"), regardless of the location of your purchases within Australia and New Zealand.

You will be responsible for keeping your information up to date, by directly modifying this at a Lacoste Store or directly through your Customer Account. You guarantee the accuracy of all the information provided and you shall be solely responsible for any incorrect, incomplete or outdated information. Under no circumstances shall we be held liable in the event you fail to receive an offer or email due to outdated, incorrect or missing information.

  1. Conditions of membership

LE CLUB LACOSTE is only offered to natural person customers. For minor natural persons aged under 18, the signature of the minor's legal representative shall be required at the time of joining.

Membership is strictly personal; only you may benefit from the benefits described below.

The use thereof by any third party is forbidden and cannot be accepted by any sales advisor in the event it is presented at the till.

You can hold one Loyalty account tied to your email address. To this end, and in the event you hold multiple accounts with different email addresses, you must selected a primary account, identified by an email address. Accounts cannot be merged.

  1. Your Customer Account

To access your personalized area (hereafter "the Customer Account") on the Website after joining at a Lacoste Boutique, or via the Website Pop Up you must activate this by creating the corresponding account on the Website. This can be done by entering the same email address you provided when joining, and creating a password, at the corresponding internet address: https://lacoste.com.au/register or https://lacoste.co.nz/register

If you joined via the Website Sign Up Page, you would have access to your personalised account (hereafter "the Customer Account") immediately after joining; this account shall be accessible via the following internet address: https://lacoste.com.au/login or https://lacoste.co.nz/login

Once you have accessed the aforementioned website, and in order to access your Customer Account, you must provide the email address and password you provided when you joined.

Among other things, the Customer Account will allow you to do the following:

  • consult your loyalty tier level,
  • modify your personal information,
  • subscribe or unsubscribe to the newsletter
  • visualize your benefits
  1. Availability and use of the customer account

The Customer Account is provided to you as is. In particular, we do not guarantee that the Customer Account shall be available and fully operational 24 hours a day, without interruptions. Access to the Customer Account may therefore be interrupted without notice in the event of technical problems or for maintenance reasons.

It is your responsibility to protect your computer, tablet, or telephone. We shall not be held liable for the damage that may be caused to your computer, tablet, or telephone, or any loss of data that may stem from your use of the Customer Account.

  1. Operation of LE CLUB

LE CLUB LACOSTE sets out four (4) loyalty tiers, namely:

  • “LEVEL 1” status (hereafter “LEVEL 1”),
  • “LEVEL 2” status (hereafter "LEVEL 2”),
  • “LEVEL 3” status (hereafter “LEVEL 3”),
  • and “LEVEL 4” status (hereafter "LEVEL 4”),

LEVEL 1 status is automatically obtained at the time of joining, while LEVEL 2 status, LEVEL 3 status, and LEVEL 4 status are only accessible if the spend threshold for that tier is reached required (“Loyalty Spend”).

Regardless of your status, you must indicate:

  • your email address and your name (as well as any other additional identification information, where applicable) at the till of the Lacoste Boutique during each visit, and prior to paying for your purchases at the Lacoste Boutique.
  • Or your email address on the Website when confirming your order; regardless of the sum of your purchases, with "purchases" referring to all purchases, with the exception of purchases made using a credit note.

We hereby inform you that any initial purchases made (whether in a Lacoste Boutique or on the Site) on the date of joining shall be immediately eligible towards your Loyalty Spend, provided that you join the Program prior to the purchase being processed.

Your purchase may only count towards your Loyalty Spend if the sales advisor is able to locate your Loyalty account, after you provide your name and email address at the Lacoste Boutique, or by providing your email address on the Website (excludes Shipping costs, discount redemptions).

Purchases made in a Lacoste Boutique and the Website will be added to your Loyalty Spend within twenty-four (24) hours of the purchase. Your spend is valid one (1) year from the time they are added to the Loyalty account.

On the other hand, in the event we issue a refund for your purchase, the value amount you have been refunded will be deducted from your Loyalty Spend balance.

You are free to consult your Loyalty balance free of charge, directly in the Customer Area or by asking at a Lacoste Boutique.

How to progress from LEVEL 1 to the other tiers?

As indicated above, Membership of LE CLUB LACOSTE grants you LEVEL 1 status.

To progress to another status, you must spend a certain amount over a period of twelve (12) consecutive months, corresponding the period of validity of your Loyalty Spend.

Therefore, to progress:

  • to LEVEL 2, you must spend a minimum of $500 over a period of twelve (12) consecutive months;
  • to LEVEL 3, you must spend a minimum of $1,500 over a period of twelve (12) consecutive months;
  • to LEVEL 4, you must spend a minimum of $2,500 over a period of twelve (12) consecutive months;

The threshold for the awarding of loyalty statuses is freely set by us, and we reserve the right to modify this at any time, at our sole discretion. In the event of modification, you will be informed of the new thresholds in force by any method we deem appropriate, including, but not limited to, by displays at Lacoste Boutiques or by the update of the General Conditions on the Website, and in the Customer Account.

Change of Tier

In the event of progression to a new tier, you will receive a confirmation email regarding your level change, new benefits and Welcome Offer, which will be sent twenty-four (24) hours after your change of status. The Customer Area will also be updated within a twenty-four (24) hour period.

The progression to a new level is valid for a fixed period of twelve (12) months from the date of the progression in question. For this period, you will receive benefits specific to this level, as described hereafter.

To retain the level acquired, you must spend the minimum amount indicated for each tier, each rolling year.

In the event you do not spend the minimum amount required for the tier, at the end of the twelve (12) months, you will automatically return to Level 1 or the tier that corresponds to the Loyalty Spend earned during these twelve (12) months, without the right to appeal this, and without any further information.

However, we hereby inform you that an information email will be sent one (1) month before the end of the validity of your current level.

Progress to the different tier will be possible again at any time, in the event your Loyalty Spend is the sufficient amount, correlating to the tier over a twelve (12)-month period, under the same conditions as set out above.

In addition, and in the event that you spend enough to access two loyalty tiers at the same time, you may accumulative all loyalty benefits, however we hereby inform you that you will only be entitled to receive the Lacoste Welcome Offer that corresponds to the highest tier, and not both, which you expressly agree to.

  1.  Benefits of LE CLUB

LE CLUB LACOSTE enables you to benefit from preferential offers, as described hereafter, based on your status. Lacoste Benefits may include gifts, discount offers on transactions as well as non-material benefits such as access to events or additional services (hereafter equally “Benefits”, “Rewards” or “Discount Offer”). We reserve the right to add, modify or remove the Benefits associated to each status at any time. Lacoste also reserves the right to add additional Benefits at any point, for which Lacoste defines the conditions of eligibility that may be based on Customer and Loyalty data such as Loyalty Tier, a Loyalty spend threshold, geographical conditions such as (but not exclusive to) the state, postcode or City of your billing or delivery addresses, your creation store or attachment store, and/or your Birthday information.

As for Discount Offers, we reserve the right to change the percentage or amount of discount as well as its eligibility and application conditions and validity duration at any time without prior notice, by updating the present General Conditions.

A. LEVEL 1

LEVEL 1 gives you access to the following benefits:

  • Access to Le Club Only Offers: you could become eligible for access to selected Le Club only offers. You will receive an email informing you when the offer is an Le Club Exclusive offer and how to access or redeem.
    • Customers who are not part of Le Club can become eligible to receive Le Club Only Offers by joining the Loyalty Program by one of the means outlined in point 3. 
    • reserved for Members that provided their email address and chose to opt-in to allowing us to use your personal information for marketing purposes;
  • Personalised content: you will receive personalised product recommendations and content based on your previously shopping or browsing activity (on the Website) and interactions with the brand. You will receive this content via email newsletters.

 

B. LEVEL 2 (Members that have spent a minimum of $500 over a period of twelve (12) months)

In addition to the benefits to which you are entitled under LEVEL 1, LEVEL 2 entitles you to the following benefits:

  • Birthday offer: Seven (7) days before your birthday, you will receive an email containing a discount of twenty AUD dollars ($20), for Australian members and twenty NZ dollars ($20) for New Zealand members, which may be used from the time of receipt of the email, for a fixed period of fourteen (14) days, for full priced purchases only at a Lacoste Boutique and on the Website (excluding sale or discounted items); this voucher may not be used in conjunction with any other promotion or sale and does not require any minimum purchase. Please note that the Birthday offer is:
    • reserved for Members that provided their date of birth;
    • reserved for Members that provided their email address and chose to opt-in to allowing us to use your personal information for marketing purposes;
    • reserved for Members that have not benefited from a birthday offer during the previous twelve (12) months;
    • conditional upon your birthday being recorded and processed by our computer systems at a minimum of seven (7) days before the recorded birth date, as per when the first Birthday Offer email is sent. Therefore, in the event you join the program within a seven (7) day period before your birthday, without our computer systems having the chance to process the information, you will not benefit from the Birthday offer for the first year, which you expressly agree to.

 

  • Welcome Offer: you become eligible for a Welcome Offer. Twenty-four hours after entering the status you will receive an email confirmation with a 15% discount code, which may be used from the time of receipt of the email, for a fixed period of fourteen (14) days, for full priced purchases at a Lacoste Boutique and on the Website (excluding sale or discounted items); this voucher may not be used in conjunction with any other promotion or sale. Please note that the Welcome offer is:
    • reserved for Members that provided their email address and chose to opt-in to allowing us to use your personal information for marketing purposes;

 

C. LEVEL 3 (Members that have spent a minimum of $1,500 over a period of twelve (12) months)

In addition to the benefits to which you are entitled under LEVEL 1&2, LEVEL 3 entitles you to the following benefits:

  • Birthday offer: Seven (7) days before your birthday, you will receive an email containing a discount of thirty AUD dollars ($30), for Australian members and thirty NZ dollars ($30) for New Zealand members, which may be used from the time of receipt of the email, for a fixed period of fourteen (14) days, for full priced purchases only at a Lacoste Boutique and on the Website (excluding sale or discounted items); this voucher may not be used in conjunction with any other promotion or sale and does not require any minimum purchase. Please note that the Birthday offer is:
    • reserved for Members that provided their date of birth;
    • reserved for Members that provided their email address and chose to opt-in to allowing us to use your personal information for marketing purposes;
    • reserved for Members that have not benefited from a birthday offer during the previous twelve (12) months;
    • conditional upon your birthday being recorded and processed by our computer systems at a minimum of seven (7) days before the recorded birth date, as per when the first Birthday Offer email is sent. Therefore, in the event you join the program within a seven (7) day period before your birthday, without our computer systems having the chance to process the information, you will not benefit from the Birthday offer for the first year, which you expressly agree to.

 

  • Welcome Offer: you become eligible for a Welcome Offer. Twenty-four hours after entering the status you will receive an email confirmation with a 15% discount code, which may be used from the time of receipt of the email, for a fixed period of fourteen (14) days, for full priced purchases at a Lacoste Boutique and on the Website (excluding sale or discounted items); this voucher may not be used in conjunction with any other promotion or sale. Please note that the Welcome offer is:
    • reserved for Members that provided their email address and chose to opt-in to allowing us to use your personal information for marketing purposes

 

  • 30 Day Offer Expiry: Extended Offer Expiries are limited to selected offers specific to the Loyalty Program and includes but is not limited to Birthday Offer and Welcome Offer.
    • Terms and Conditions in the offer emails will communicate which offers are subject to a thirty (30) day extension and the expiry date will be listed as such in the email terms and conditions.

 

  • Pre-order Access to Exclusive Collections: You could become eligible for pre-order access to selected collections and collaborations. You will receive an email informing you when the pre-order option is available on a collection and instructions on how to access the product.
    • reserved for Members that provided their email address and chose to opt-in to allowing us to use your personal information for marketing purposes;
    • Pre-order is an exclusively ecommerce feature available only at lacoste.com.au or lacoste.co.nz and not offered in Lacoste Boutiques.

 

D. LEVEL 4 (Members that have spent a minimum of $2,500 over a period of twelve (12) months)

In addition to the benefits to which you are entitled under LEVELs 1,2 & 3, LEVEL 4 entitles you to the following benefits:

  • Birthday offer: Seven (7) days before your birthday, you will receive an email containing a discount of fifty AUD dollars ($50) for Australian members and fifty NZ dollars ($50) for New Zealand members, which may be used from the time of receipt of the email, for a fixed period of fourteen (14) days, for full priced purchases only at a Lacoste Boutique and on the Website (excluding sale or discounted items); this voucher may not be used in conjunction with any other promotion or sale and does not require any minimum purchase. Please note that the Birthday offer is:
    • reserved for Members that provided their date of birth;
    • reserved for Members that provided their email address and chose to opt-in to allow us to use your personal information for marketing purposes;
    • reserved for Members that have not benefited from a birthday offer during the previous twelve (12) months;
    • conditional upon your birthday being recorded and processed by our computer systems at a minimum of seven (7) days before the recorded birth date, as per when the first Birthday Offer email is sent. Therefore, in the event you join the program within a seven (7) day period before your birthday, without our computer systems having the chance to process the information, you will not benefit from the Birthday offer for the first year, which you expressly agree to.

 

  • Welcome Offer: you become eligible for a Welcome Offer. Twenty-four hours after entering the status you will receive an email confirmation with a 20% discount code, which may be used from the time of receipt of the email, for a fixed period of fourteen (14) days, for full-priced purchases at a Lacoste Boutique and on the Website (excluding sale or discounted items); this voucher may not be used in conjunction with any other promotion or sale. Please note that the Welcome offer is:
    • reserved for Members that provided their email address and chose to opt-in to allow us to use your personal information for marketing purposes

 

  • 60-Day Offer Expiry: Extended Offer Expiries are limited to selected offers specific to the Loyalty Program and include but is not limited to Birthday Offer and Welcome Offer.
    • Terms and Conditions in the offer emails will communicate which offers are subject to a sixty (60) day extension and the expiry date will be listed as such in the email terms and conditions.

 

  • Access to La Lodge: You will become eligible for access to La Lodge. Access to La Lodge may include but is not limited to personalised gifts, shopping experiences, branded events and ticket lotteries. The aforementioned gifts, experiences, events and lotteries are offered on a discretionary basis to individual members of La Lodge and are subject to change.

 

  • Further 10% off selected sales. After entering Level 4, you become eligible to receive a further 10% off selected sales. This offer is only available for redemption on the Website. You will receive an email informing you when the further 10% can be applied to a sale, the timeframe the offer is valid for, and instructions on how to receive the further 10% discount.
    • reserved for Members that provided their email address and chose to opt-in to allow us to use your personal information for marketing purposes;

 

  1.  Returns of an order with a loyalty discount

In the event of a return in which Loyalty discounts were used on the Website or in a Lacoste Boutique: you cannot claim restitution of eligibility to said Loyalty Discount Offer.

  1.  Liability

We deny any liability regarding any harm, death, delay, injury or losses stemming from or in direct relation with the services, bonuses or benefits provided or not provided in the context of LE CLUB LACOSTE, to the exclusion of the losses and damages stemming from negligence committed by Lacoste, or provoked by this party with the intention to cause the aforementioned damage, or stemming from careless actions committed knowing that this would probably result in damage.

  1.  Fraudulant use

LE CLUB LACOSTE is a program aimed at providing benefits for Members based on the purchases they make at a Lacoste Boutique or on the Website and assumes that the Member respects the General Conditions and adopts loyal behaviour with regard to Lacoste, respectful of the Lacoste Brands.

In addition:

any breach of the General Conditions;

  1. any fraudulent use of the LE CLUB LACOSTE Loyalty program by the Member or by any third party acting on behalf of the Member;
  2. any action that intends to disrupt the Loyalty program, the Website or any Lacoste Store;
  3. any abnormally high number of transactions carried out in the same day or over several days;
  4. in the event of a payment incident that is not resolved within thirty (30) days of the purchase date; shall result in the lawful cancellation of all transactions, as well as the deactivation and the deletion of the loyalty account without compensation of any kind.
  5. We reserve the right to carry out verifications of adherence to the General Conditions at any time.  

 

  1.  Deactivation of loyalty account

In case you wish to deactivate your Loyalty account, please contact our customer service via the following contact form: lacoste.com.au/contactus/

  1. Modification or termination of the loyalty program

We reserve the right to modify or eliminate LE CLUB LACOSTE (conditions of membership, benefits linked to the Loyalty account, etc.) and/or the conditions of use of the Loyalty account, at any time. In the event of termination of LE CLUB LACOSTE, we will allow you the possibility to redeem any active discount offers for a period of one (1) month of informing you of this, by any method we deem appropriate. If you fail to redeem any offers during this time, the loyalty benefits shall be definitively lost.
